    Terms of Service.

    These Terms of Service ("Terms") govern your use of Hourpath ("Service") provided by Hourpath LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

    1. Description of Service

    Hourpath is a digital platform designed to help pre-licensed mental health professionals track clinical supervision hours, manage licensing requirements, and monitor progress toward professional licensure.

    Hourpath is a tracking and organizational tool only. We do not provide legal, clinical, or professional advice regarding licensing, supervision, or practice requirements.

    You are solely responsible for verifying all requirements with your state licensing board and for maintaining compliance with all applicable laws, regulations, and ethical standards.

    State-Specific Compliance Responsibilities

    Hourpath is a supplemental tracking tool and does not replace official state board portals or requirements. Users are responsible for:

    • •Florida (Rule 64B4-2.0025): Both interns and supervisors must maintain up-to-date copies of supervision logs. Users should generate and save periodic PDF exports to meet state requirements for simultaneous record maintenance.
    • •Ohio (Rule 4757-17-01): Hourpath is supplemental to Ohio's eLicense portal. Supervisees bear full responsibility for maintaining accurate records as required by the board.
    • •All States: Users must verify that Hourpath's tracking aligns with their specific state board requirements and deadlines.

    2. Eligibility and User Accounts

    To use Hourpath, you must:

    • •Be at least 18 years old
    • •Provide accurate and complete information
    • •Maintain the confidentiality of your login credentials
    • •Use the Service only for lawful, professional purposes

    You are responsible for all activities that occur under your account, including any actions by persons who access your account using your credentials.

    We reserve the right to suspend or terminate accounts that violate these Terms or present a security or compliance risk.

    3. Subscriptions and Payments

    Plans

    • •Monthly and annual subscription options (pricing available on our website)

    Billing

    • •Payments are securely processed by Stripe.
    • •Subscriptions automatically renew unless canceled.
    • •You may cancel anytime through your account settings; cancellation takes effect at the end of the current billing cycle.
    • •Price changes will be communicated at least 30 days in advance.

    Refunds

    Except where required by law, all fees are non-refundable once paid.

    4. Data and Privacy

    Ownership

    You retain ownership of all data you enter into Hourpath. We use your data solely to provide and improve the Service, as outlined in our Privacy Policy.

    Data Access and Export

    You may export your data at any time from within your account.

    Upon cancellation: Your account enters "Read-Only" mode. Your data is retained for 7 years to meet professional record-keeping standards. During this period, you may view your historical data, but a paid subscription is required to export records, add new entries, or generate official forms. After the 7-year retention period, data may be permanently deleted unless required by law.

    Security

    We use industry-standard technical and organizational measures to protect your data, including encryption and access controls. However, no online service is completely secure, and you acknowledge this inherent risk by using Hourpath.

    5. Acceptable Use

    You agree not to:

    • •Violate any local, state, or federal laws
    • •Infringe on intellectual property or privacy rights
    • •Upload or transmit malicious code or attempt to disrupt the Service
    • •Use the Service for fraudulent, deceptive, or harmful purposes
    • •Share your account with others or misrepresent your identity

    Violation of this section may result in account suspension or termination.

    6. Intellectual Property

    The Service, including its design, code, and content, is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use Hourpath solely for your professional development.

    You may not:

    • •Reverse-engineer or attempt to extract source code
    • •Use the Hourpath name or logo without written permission

    All rights not expressly granted to you remain with Hourpath LLC.

    7. Disclaimers and Limitation of Liability

    Service Provided "As Is"

    Hourpath is provided "as is" and "as available." We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

    Limitation of Liability

    To the fullest extent permitted by law:

    Our total liability for any claim is limited to the amount you paid to Hourpath in the 12 months preceding the claim.

    We are not liable for:

    • •Decisions you make regarding licensure or supervision
    • •Data loss caused by user actions or third-party failures
    • •Temporary service outages or interruptions
    • •Consequences of inaccurate or incomplete data input
    • •Indirect, incidental, or consequential damages

    If you rely on Hourpath for compliance or recordkeeping, you are responsible for verifying accuracy and backup.

    8. Termination

    We may suspend or terminate your account if you:

    • •Violate these Terms
    • •Misuse the Service
    • •Fail to pay subscription fees

    Upon termination:

    • •Access to the Service ends immediately and your account enters "Read-Only" mode.
    • •Your data is retained for 7 years per our data retention policy (see Section 4).
    • •Outstanding payments remain due.

    You may delete your account at any time through your settings or by emailing support@hourpath.app.

    9. Changes to These Terms

    We may modify these Terms from time to time. Material updates will be communicated via email or in-app notice at least 30 days before they take effect. Continued use of Hourpath after changes means you accept the updated Terms.

    10. Governing Law and Dispute Resolution

    These Terms are governed by the laws of the State of Washington, USA, without regard to conflict of laws principles.

    Any disputes will be resolved through binding arbitration in King County, Washington, unless otherwise required by law. You agree to waive any right to participate in a class action or jury trial.

    11. Entire Agreement

    These Terms, together with our Privacy Policy, form the entire agreement between you and Hourpath LLC. If any provision is found unenforceable, the remaining provisions will remain in effect.
